HC asks NHAI to reply on legality of toll plaza

The state president of Congress business cell Kanhaiyya Agrawal on Monday informed that the High Court had asked National Highway Authority of India (NHAI) to reply on legality of toll plaza near Sundar Nagar Raipur in 21 days in an affidavit.

“The HC issued this order while hearing on public interest litigation (PIL) filed against DS Construction (the agency hired by the NHAI to build fourlane road at Ring Road No 1) and the government for attempting to construct toll plaza in municipal limits,” Agrawal said.

“The HC has asked the NHAI whether it followed all the given norms before selecting toll plaza near Sundar Nagar or not,” he added.

“Earlier, the HC had stayed the toll plaza construction in city limits. To justify that the site selected for toll plaza was appropriate, the state’s Public Works Department (PWD), NHAI and DS Construction had appealed to court, although their argument submitted in an affidavit was illogical and baseless,” he said.

He alleged that the PWD provided wrong information to the court through affidavit by showing Sarona, Raipura and Changora Bhatha out of municipal limits in 2004. “According to gazette published on December 31, 2003, all these three areas had been included in municipal limits,” he indicated.

“We condemn the PWD for giving wrong information to the HC with an aim to benefit DS Construction. This proves that the PWD is more eager for commencement of toll plaza than the implementing agency,” he said.
